Callista’s case adjourned again

The High Court in Malawi’s commercial city, Blantyre, was on Friday forced to adjourn a case involving former first lady Callista Mutharika and her stepchildren who are fighting over ownership of the opulent Casa Blanca Manor at Ndata Farm in Thyolo.

Lawyer representing Callista, Meyer Chisanga, applied for an adjournment on the basis that he was not prepared as he was served with affidavit in opposition and skeleton arguments by the late president Bingu wa Mutharika’s children on Thursday.

Callista obtained an ex-parte injunction earlier, restraining Bineth Trustees from evicting her from Ndata Farm.

The court was to hear both sides on the matter, with Callista expected to argue to maintain the injunction. On the other hand, Bineth argued for its dismissal to force her out of Casa Blanca.

The court adjourned the case to November 22.

Just this week, another legal fight between the two parties ensued after Callista went to court and obtained letters of administration of Mutharika’s deceased estate.

The letters of administration effectively meant that Callista was in control of Mutharika’s deceased estate, including Ndata Farm. But Bingu’s children Madalitso, Tapiwa and Duwa, within few hours of Callista’s move, rushed to the same court and got an injunction, restraining their stepmother from administering the deceased estate.
