The Mangochi First Grade Magistrate’s Court yesterday dismissed a claim of K85 000 as compensation filed by trader Paulo Msangwa after irate people confiscated and buried the pork he was selling in the district.

Court records show that Msangwa on October 24 this year slaughtered a pig and went to sell it at Maldeco Market in the district.

“The plaintiff [Msangwa] was ordered to stop selling the meat by Bulugama Makunganya and his friends who told him that Muslims are not allowed to be exposed to pork as it was Haram [forbidden] to their religion. But Msangwa continued selling the pork and this annoyed the defendants who seized the meat and buried it,” said a source familiar with the case.

In his ruling, first grade magistrate Jack Njikho said the plaintiff was wrong because he continued selling the pork despite being told that the area prohibits people from selling pork.

Further to this, the magistrate also found the defendants in the wrong for burying the meat as that was taking the law into their own hands.

Msangwa, 32, comes from Chipoka Village in the area of Traditional Authority (T/A) Mponda in the district whereas Makunganya is from Michesi Village in the same area.

    1. Yes school ndiyofunika. The guy was warned not to sell pork and he continued. I am a proudly educated Muslim who hold a BSc honours degree. Respect other people’s beliefs. It is common knowledge that Mangochi is a predominantly a Muslim area, so it follows that selling pork at a public market may cause problems. The magistrate even said the guy was warned but did not take heed. Any reasonable person could not sell pork at a public market in Mangochi. Education is there to give us an open mind so we are able to asses the situation on the ground.

Being a predominantly Muslim area does not give them the right to impose their own laws on the rest of the populace. Look at what is happening in Nigeria! Those of us who do not agree with the magistrate’s decision are basing our argument that Muslims do not have any legal powers to stop the man from selling pork in a public market. There are actually rules on how to conduct business in markets. Nowhere does it state that Mangochi is a special case in Malawi.

These people should not force their religion on people, in Mangochi there are also other people who’s religion do not stop them from selling and eating pork.Mwayambapo etii, zinayambatu chonchi ku Nageria pano ndi izi.     1. No one is being forced to be a Muslim. It is only that one must not sell pork in a public market in Mangochi which is a predominantly Muslim district.

  3. The media is awash with questionable actions from the judiciary. Yesterday it was a judge who recused himself from an ongoing case for the flimsiest of reasons. Today its this magistrate who upholds religious law as if Malawi follows sharia law. Mangochi is like any other part of the country, and therefore pork may be sold there. Think of the implications of this ruling. Other religions may make their own laws just because they are the majority population in a particular location.

    1. The magistrate’s ruling is not questionable in any way. The guy was warned not to sell pork in a public place market in Mangochi. He even found that the defendants took the law into their own hands by burying the pork.. There is nothing wrong in a judge or magistrate in recusing himself or herself for any reason whatsoever. Do not think that your opinions will always prevail.

      1. Question is, who warned him not to sell pork in the area? If it is the muslims, where do they get legal authority to issue such a warning?
        With reference to the issue of the judge recusing himself, my argument (which others have already made) is that having the same home district is hardly an excuse to shy from hearing a case, because people from all over the country pass through our courts all the time.
        I am not trying to force my opinion on others; merely inviting them to think critically.

  4. That is how Sharia law starts, we do not need lawless enclaves in Malawi. The pig meat was being sold in a market and not in a mosque. Did the magistrate took into consideration the fact that there were buyers there? What about there right to eat pork? If pork is not allowed to be sold in Mangochi where will these people who call Mangochi their home get their daily pig meat supplement?
    Please Mr Msangwa take this case to the high court, if you do not have enough funds let legal aid help you. This a case is of national importance if Malawians want to co-exist regardless of their religous believes.

    1. Sharia law is not synonymous with lawless. Pig not to be sold in a public market in Mangochi. period. Those buyers in Mangochi who may want to buy pork can do so in those butcheries and supermarkets that sell pork. The case of course is of national importance and Muslims also need respect and co-exist with other religious and non-religious people.

      1. What a load of rubbish man! Malawi is not governed by the bible or the quran. Malawi is a secular state and a seller has the right to sell pork from Nsanje to Chitipa. We cannot have sharia enclaves in the country. A muslim has the right not to buy the pork as guided by his beliefs in the same way a non-muslim has the right to buy pork if he so wishes. The country cannot have different laws for different parts of the country, nor can we have different laws for different religious groups.

Why should markets in Mangochi be any different from those in any other parts of the country? And, to follow your line of logic, why should the butcheries and supermarkets be exempt, since they are also operating in the same district?
        Your final sentence actually defeats your whole argument. Muslims want respect from other people yet they are not ready to tolerate a single trader, who is not even forcing them to buy the meat!

  6. What about beer/lager sold in Mangochi? Is this allowed or not? Mu ma hotel monsemo timadya pork chops, sausages, bacon, etc., shall our tourists have to comply to these shariah rules? Which is worse eating pork or screwing the young naked girls who ask for it at Maldeco?

  8. The Judge has feared the wrath of moslem. I know Sangwa personally and he did not open a butchery. He sells secretly. On the material day, he was just passing by Maldeco Market, when these illiterate moslems approched him with hostility.

    Now that justice has corrupted I advise Sangwa to attack these people indirectly so that he inflicts pain on these useless people.

    The Trade Act does not condone let alone prohibit people from selling certain products from public places. A Njikho mwakalamba, kapumeni.

This is very bad, magistrate has done his duties well he didnt consider the right of other people living in mangochi. there are more people from other party of the country working there in health centres, schools, where will they get the this pork if they feel like enjoying it one? I can see employees who are not moslems refusing to be transfered to Mangochi or those who are already there asking for transfers. How about moslems who are in other districts where moslems are in minority do they want to see people selling pork or they should go and stay in mangochi? Ma mosque munamanga paliponse ndi ndalama za Gadaffi bwanji mumatisokosera mmamawa tisakufuna kudzuka amvekere wooooooooooooooooooooooooooo wati!wati! wooooo! watiwati eish!

  11. There is nothing strange with this ruling. Ndiomwewa amene anapanga set muburundi free atagwiririra mwana on the premise that mwanayo sanamve kuwawa. Ma judge aku Malawi ndiamenewo. Go to chanco mukawapeza mu libra akukoperana ma case akuti xool imeneyo and what do u expect from them? That case together wth this one just shows how shallow minded our so-called learned men are. I hope lawyer wina amene ali mkhristu will offer to challenge this stupid, ignorant and dangerous ruling in high court for free.

  12. The magistrate is also afraid of reprisals from these extremists also known as Boko Haram in Nigeria and Al Shabab in Somalia. We have national laws and not Mangochi laws or bye-laws. Why do they not ban prostitution that takes place there? Why do they not ban selling beer in the same area? Why pork when they do not even eat it?

  13. Not only in Mangochi but its everywhere in Malawi. What i have been seeing is that pork is not just sold everywhere, it has sort of confinement. I’m not a muslim, but to take pork where majority don’t tolerate is wrong. On another note, let it be known that most of the best old lawyers have gone through the Mpemba corridors, hence do not think best comes only from Chanco that is thinking with buttocks.
