AG obtains injunction against health staff strike
Striking healthcare workers have vowed to challenge an injunction the Industrial Relations Court (IRC) granted Attorney General Thabo Chakaka Nyirenda yesterday stopping them from proceeding with their sit-in.
Physician Assistants Union of Malawi (Paum) president Solomon Chomba said in an interview that they believe there was no proper procedure in the application of the injunction.
He said: “We have suspended the sit-in in respect of the injunction obtained by government. We, however, have not seen the skeleton documents, but we have the sit-in on hold to respond to the legal issues.”
The restraining order dated June 10 2024 was granted at the IRC in Lilongwe yesterday and Nyirenda’s office is representing Ministry of Health, which has taken to court National Organisation of Nurses and Midwives in Malawi (Nonm) and Paum as first and second defendants.
Reads the order: “An order of urgent relief be and is hereby granted restraining the respondents through themselves, or through their members, agents or proxy howsoever from proceeding with the intended strike on June 10 2024 or any subsequent days… and that the applicant do file inter-partes motion for urgent interim relief within 14 days from the date thereof.”
Yesterday, healthcare workers rebuffed government’s move to offer an undisclosed percentage of their allowances, saying they have not changed their plans to stage a sit-in from Monday.
In a letter dated June 7 2024 signed by Department of Human Resource Management and Development Principal Secretary Ian Chingwalu, the government acknowledged receipt of the request.
