Banned CCL golfers’ case leaves court

Country Club Limbe (CCL) and golfers Imran Daudi and Levison Kapito have agreed an out-of-court settlement in the case where the two golfers sought a High Court order to stop the club from banning them for a year.

According to a lawyer representing the golfers, Steve Msiska, Judge Healey Potani assented to the agreement at the High Court in Blantyre on Monday upon CCL management’s request to have the issue vacated from the court.

On November 26, Potani adjourned the case to Monday, December 9 after CCL asked for more time to find a legal team to represent them.

“We have agreed that the issue should be resolved out of court because CCL has indicated that it might reverse its decision to suspend my clients. We are keeping our fingers crossed to hear good news from them,” said Msiska.

CCL vice-captain for the golf section Chimdima Mhango said he could not comment as it was the club’s manager who was following the matter at the court.

Daudi and Kapito were banned from the CCL greens after they protested their exclusion from Old Mutual Golf Championships prize receiving list because their club had not yet subscribed to the latest computerised South African Golf Association (Saga) handicapping system.

The golfers are currently serving a five-year suspension from the BSC golf course, but they expressed dissatisfaction with the CCL ban because, they argued, it was meted out before hearing them.
