High Court clears 67% of election petitions

The High Court of Malawi has cleared 63 of the 94 electoral cases mostly relating to parliamentary elections in the September 16 2025 General Election, drawing commendation from stakeholders.

The disposal rate represents a 17 percent increase since November 11 when 54 cases had been completed.

Judiciary data indicate that Lilongwe Registry completed 31 cases followed by Blantyre with 18 cases, Zomba with 11 and Mzuzu with three.

Out of the 94 cases recorded, Lilongwe Registry received 49 while Blantyre had 24, Zomba had 15 and Mzuzu had six.

National Advocacy Platform (NAP) chairperson Benedicto Kondowe said the progress reflects the Judiciary’s commitment to upholding electoral justice without compromising due process.

He said: “The pace set so far reflects commendable institutional focus, and sustaining this momentum will be critical to ensuring that all remaining petitions are concluded with the same diligence, fairness and transparency.”

In a separate interview, Centre for Multiparty Democracy executive director Boniface Chibwana yesterday also stressed the importance of timely adjudication.

“It would not be prudent to adjudicate electoral related issues six months after polling had taken place,” he said.

One of the pending matters in the High Court involves a petition by independent candidate Joseph Manguluti who is challenging former Minister of Finance Simplex Chithyola Banda’s victory in Kasungu South Constituency.

The judgment, initially scheduled for November 25, is now expected to be shared with parties to the case.

Meanwhile, the High Court of Malawi on Monday nullified a Malawi Electoral Commission (MEC) declaration of Democratic Progressive Party (DPP) candidate Martha Munthali-Ngwira as winner of the parliamentary race in Mzimba Hora Constituency.

The court also set aside MEC’s decision that nullified the election for Lilongwe City Mtandire-Mtsiriza Constituency where Minister of State Alfred Gangata, a Democratic Progressive Party candidate, was declared winner.
