Nyamirandu seeks judicial review on contract termination

Former Anti-corruption Bureau (ACB) assistant director (Legal and Prosecutions) David Nyamirandu has asked the High Court to grant leave for a judicial review on the termination of his contract.

The ACB did not renew Nyamirandu’s contract and he sued the bureau, minister responsible for Public Service Management and the Attorney General (ACB).

Nyamirandu, who was employed on March 22 2010 on a three-year contract that expired in March 2013, through his lawyer Burton Mhango, told High Court Judge Mike Tembo that he had a legitimate expectation before and after the expiry of his contract that it would be renewed.

He questioned the legality of the decision by the ACB not to renew it.

And in his affidavit in support, Nyamirandu argued that there was no indication from the ACB director or anyone that his contract would not be renewed.

Nyamirandu, who was on a month-to-month contract since March, learnt on October 29 2013 that his contract had not been renewed.

In response, ACB chief prosecutor David Bandawe told the court that government did not fire Nyamirandu, but that his contract expired in March this year.

He also argued that the retirement age in ACB is 55 and that Nyamirandu was over 70 which was far beyond the retirement age.

But Mhango dismissed Bandawe’s assertion on age, saying Nyamirandu was on a non-established contract hence his contract did not follow all the rules and regulations of ACB.
