Sheriffs impound BB team bus over K25m

FCB Nyasa Bullets on Wednesday confirmed that sheriffs have impounded their Higger team bus for failing to honour a court order to pay their former coach Franco Ndawa K25 million as compensation for breach of contract.

In a statement released on Wednesday, the club’s chief administration officer Albert Chigoga said the issue is backdated to 2016.

He said the court determination was made before Nyasa Manufacturing Company took over the ownership of the team.

Said Chigoga: “The sheriffs came to the office to impound the bus today.

“The truth of the matter is that the club hired Ndawa on a three-year contract in 2016, but six months later, he was relieved of his duties and he took the matter to court.

“When Nyasa Manufacturing took over, we tried to contest the matter on the basis that the club was under new ownership, but the court ruled that Mr. Ndawa had a valid case since the team was still in existence.

“A ruling was made in his favour and following an assessment, a sum of K25 million was awarded to him. We tried to contest the figure, but it stood until now that the sheriffs have impounded our team bus.”

He said the club’s lawyers are trying to see how best they can address the issue.

Ndawa on Wednesday confirmed that his lawyers sought the intervention of the sheriffs because Bullets were not honouring the court order.

He said: “My contract was for three years, but barely months down the line, I was dismissed and the term they used in their letter was ‘dip in form’.

“So, I took up the matter with my lawyers who sued for breach of contract leading to the court awarding me K25 million.

“Initially, it was not my intention to go that far [to seek sheriffs’ intervention], but my patience wore thin because the club was not being cooperative. The assessment was done last year, but they could not do the needful, leading to the latest development.”

The bus was bought for Bullets by immediate-past president Peter Mutharika in 2020 alongside that of their rivals Mighty Mukuru Wanderers at a reported  price of K125 million each.
