NAM, Peace negotiations hit snag
Netball Association of Malawi (NAM) and former Malawi Queens coach Peace Chawinga-Kaluwa have failed to reach an out-of-court agreement in a case she is seeking compensation for unlawful dismissal.
The two parties have been involved in the negotiations since last year when the Malawi National Netball Team legend took the matter to the Industrial Relations Court (IRC) through her lawyers Makiyi, Kanyenda and Associates.
In an interview yesterday, Chawinga-Kaluwa’s lawyer David Kanyenda confirmed that the negotiations had reached a dead-end.
He said: “Recently, we held a series of meetings with NAM officials, including the president and GS [general secretary].
“They made us some offers on a without prejudice basis, but we were unable to reach a negotiated settlement and, therefore, the matter shall proceed formally in the IRC.”
However, Kanyenda could not be drawn to comment on the offer that the association made.
“Ask them, they should be in a better position to tell you,” he said.
On the other hand, NAM general secretary Yamikani Kauma confirmed in an interview that the negotiations flopped, saying: “It is true, we had several meetings, but we failed to reach a settlement.”
She, however, declined to disclose the offer they made to the coach.
The out of court negotiations started with the immediate-past executive committee led by Abigail Shariff.
Chawinga-Kaluwa wants the court to declare that NAM unlawfully terminated her contract, constructively discriminated against her under Section 60 of the Employment Act and defamation.
